1.1. Thanks for using Serai Third Party Content Delivery Service (the Service).
2. Serai's role
2.1 As the provider of the Service, we are responsible only for the delivery of the content provided by the Third-Party Content Provider set forth above (the Content) to you. When you purchase the Service, Serai Limited is the merchant of record. This means while we deliver the Content to you, it is generated and licensed to you by the Third-Party Content Provider.
3. Licence of the content
3.1 The Content is provided by the Third-Party Content Provider and is licensed to you in accordance with the End User Licence Agreement set forth above.
3.2 We act as an agent for the Third-Party Content Provider in providing the Service and is not a party to the EULA. You acknowledge and agree that we are a third-party beneficiary of the EULA and may therefore enforce such agreement.
3.3 The Third-Party Content Provider is solely responsible for the Content, its warranties and any claims that you may have related to the Content.
4. Serai's Responsibilities
4.1 While we make reasonable efforts to check the accuracy of the descriptions of the Service, the Third-Party Content Provider is solely responsible for any representations contained in those descriptions.
4.2 We do not endorse or assume any responsibility for the Content. In case of any failure in the Service, your sole and exclusive remedy from us is replacement of the Content [or refund of the Service Charge.
5. Availability of the content
Once you have purchased the Service, the Content will be made available on the relevant service dashboard and may be viewed by you and by any user(s) associated with your Business
Serai Limited is not licensed by the Securities and Futures Commission or any other financial market regulator. For the avoidance of doubt, Serai Limited does not carry on or hold itself out as carrying on a business in a regulated activity within the meaning of the Securities and Futures Ordinance (Regulated Activity) nor does it hold itself out as performing any regulated function in relation to a Regulated Activity carried on as a business.
